wow all i did today was add my custom them to the xbox this sucks so badly. I just recovered that 3 year old account and now It's hopeless.! I was really getting into RE6 man damn! I don't think they would know about a theme. Also a theme isn't a account mod. 99+% chance it was something else you did to your account that they just got around to looking into.

Only 1 thing to do. Make a new account. There is no way to unlock that account. You could contact them about it and claim you did nothing wrong but it wouldn't work.
the account is 3 years old and I did get passed 250k legit...Then I got bored and started modding etc
Happens to the best of us . I've lost about 5 accounts over 5 years. The main 1 holding about £450 worth of DLC. What I have done now is I have 1 account to mod and play multiplayer on and another for all my DLC and Cheevo's

lol it wasnt the theme i just said that was the only thing i did yesterday not the thing that got me in trouble.
