Certain Kmart stores apparently began selling the game early this week.

A handful of lucky gamers have Call of Duty: Modern Warfare 3 in their hands right now -- and they didn't get it by downloading the leaked version currently floating around the Internet.
At least one Kmart store (located in Tampa, Florida) began selling the game in its electronics department despite its release being scheduled for November 8, Kotaku reports. Copies have also shown up on eBay (where the image below comes from) and Craigslist in New York at inflated prices.
The appeal of the Call of Duty games for many is their online multiplayer component. Given that, you'd think the incredibly small number of people with the game in hand would make the prospect of paying $200 or more for an early copy an unattractive option, but that hasn't stopped these early buyers from trying to turn a big profit.

The game apparently began being sold early because the boxes that copies of it were shipped in instructed employees to begin selling it immediately instead of waiting for next Tuesday. The store nearest to me didn't have it in stock, but then again, I was also told they hadn't received Uncharted 3, which should have went on sale November 1.
Should you be fortunate enough to end up with an early copy, there's no need to worry about repercussions from playing on an Xbox Live-connected system -- assuming it's a legitimate copy. Xbox Live director of policy and enforcement Stephen Toulouse wrote on Twitter a short while ago, "For those asking about MW3 pre-release play: If your copy is legit and obtained legitly, have fun. It's a great game." Those who head online with the aforementioned leaked copy can count on a ban if they're detected on Xbox Live.
Even if you don't have the game yet, you can, for some reason, pre-order a subscription to Call of Duty Elite. The $49.99-per-year price tag entitles you to all of the upcoming year's worth of downloadable content (including early access), extra storage for replay videos, the ability to level up your clan, access to tournaments where you can win real-life prizes, Elite TV, and more. Alternatively, a free year of Elite comes included with the $100 Hardened Edition, allowing you to save $10 off buying the game and Elite individually.
